Chris

I have been involved in two civil Supreme Court cases in Australia where both Judges directed the opposing experts to confer and identify common opinion and matters of disagreement.

The first court matter was adjourned for two months so that this could be done. We had our conference recorded and transcribed although this wasn't a legal requirement, and ultimately the matter was resolved without further court action.

In the second case the Judge just asked the experts to confer outside the court on the conflicting issues to see if some agreement of opinions could ever be reached.

I have heard of other cases in Australia where this has occurred but it is not a common happening.
