Bob Cole has stated correctly. Hot Shock is positive evidence of filament illumination, the absence of hot shock does not mean the filament was n't illuminated; It is inconclusive.
It would be extremely unlikley that anyone would intentionally disable the DRL system. It is wired into the ignition and switches the lights on when the key is turned.
Eye witnesses are another extreme as far as their credibility is concerned. Rely on the physical evidence.
